BrewHop is intended exclusively for individuals who are 21 years of age or older. By downloading, installing, or using the BrewHop application, you represent and warrant that you are at least 21 years of age. Users under the age of 21 are strictly prohibited from accessing or using the app. If you are under 21, do not download, install, or use BrewHop.

These Terms of Use (the "Terms") govern your access to and use of the BrewHop mobile application (the "App") and any related services, features, or content offered by Webheadcase LLC (referred to herein as "Webheadcase LLC," "we," "us," or "our"). BrewHop is a brewery and craft beer discovery platform available on iOS and Android that helps adults find nearby breweries, view taproom menus, check hours, and plan hop itineraries.

By downloading, installing, registering for, or otherwise using the BrewHop App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms in their entirety, you must not download, install, or use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Webheadcase LLC. Please read them carefully before proceeding.

1. Acceptance of Terms

​

1.1 Agreement by Use

​

By clicking "I Agree," downloading, installing, accessing, or otherwise using the BrewHop App in any manner, you confirm that you have read and agree to be legally bound by these Terms. Your use of the App constitutes your acceptance of these Terms as of the date of first use.

​

1.2 Modifications to These Terms

​

Webheadcase LLC reserves the right to modify, update, or revise these Terms at any time in its sole discretion. We will provide notice of material changes via:

• An in-app notification or banner; or

• An email to the address associated with your account.

Notice of material changes will be provided at least 30 days in advance of the effective date of such changes, except where changes are required by law or are necessary to address security concerns, in which case shorter notice may be given.

1.3 Continued Use as Acceptance

​

Your continued use of the App following the effective date of any revised Terms constitutes your binding acceptance of those revised Terms. If you do not agree to any modification, you must discontinue your use of the App and may terminate your account as described in Section 14.

​

2. Eligibility

​

2.1 Age Requirement

​

You must be at least 21 years of age to use BrewHop. By using the App, you represent and warrant that you meet this age requirement. This restriction exists because BrewHop is a platform centered around the discovery of alcoholic beverages and licensed establishments.

​

2.2 Legal Capacity

​

You must be a legal resident or citizen of a jurisdiction in which you have the legal capacity to enter into a binding contract under applicable law. If you are using the App on behalf of an entity, you represent that you have the authority to bind that entity to these Terms.

​

2.3 No Prohibited Use

​

You must not be prohibited from receiving or using the App under the laws of the United States or any other applicable jurisdiction. You may not use the App if doing so would violate any law or regulation applicable to you.

​

2.4 Age Verification

​

Account registration requires you to provide an accurate date of birth for the purpose of age verification. Providing a false date of birth is a violation of these Terms and may result in immediate account termination. Webheadcase LLC reserves the right to implement additional age verification measures at its discretion.

2.5 Enforcement

​

Webheadcase LLC reserves the right to suspend or permanently terminate the account of any user determined to be under the age of 21, or otherwise ineligible under these Terms, without prior notice and without liability.

​

3. Account Registration and Security

​

3.1 Account Creation

​

You must create a registered account to access the full features of BrewHop. During registration, you agree to provide information that is accurate, current, and complete, including but not limited to your name, email address, and date of birth. You agree to keep this information updated as necessary.

​

3.2 Confidentiality of Credentials

​

You are solely responsible for maintaining the confidentiality of your account login credentials (username, password, and any authentication tokens). You agree not to share your credentials with any third party and to take reasonable steps to prevent unauthorized access to your account.

​

3.3 Account Responsibility

​

You are responsible for all activity that occurs under your account, whether or not authorized by you. Webheadcase LLC will not be liable for any loss or damage arising from your failure to maintain account security.

​

3.4 Unauthorized Access — Reporting

​

You must notify Webheadcase LLC immediately if you become aware of any unauthorized use of your account or any other security breach by contacting us at: webheadcase@webheadcase.com. Webheadcase LLC is not liable for any loss resulting from unauthorized use of your account prior to such notification.

​

3.5 One Account Per User

​

You may maintain only one (1) active BrewHop account. Accounts are personal to the registered user and are non-transferable. You may not sell, assign, or otherwise transfer your account or account credentials to another person or entity.

​

3.6 Suspension and Termination

​

Webheadcase LLC reserves the right to suspend or terminate any account that violates these Terms, that has been inactive for an extended period, or for any other reason at Webheadcase LLC's reasonable discretion.

​

4. License to Use the App

​

4.1 Limited License Grant

​

Subject to your compliance with these Terms, Webheadcase LLC grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the BrewHop App on a mobile device that you own or control, solely for your personal, non-commercial purposes.

​

4.2 Restrictions

​

You may not, and you agree not to:

​

• Copy, modify, adapt, translate, create derivative works of, or distribute the App or any portion thereof;

• Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App, except as permitted by applicable law;

• Sell, sublicense, rent, lease, transfer, assign, or otherwise exploit the App or your rights under these Terms for any commercial purpose without prior written consent from Webheadcase LLC;

• Use automated systems, bots, scrapers, crawlers, or other unauthorized means to access, extract data from, or interact with the App;

• Remove, alter, or obscure any proprietary notices, labels, or marks on or within the App;

• Use the App in any manner that violates applicable local, state, national, or international law or regulation.

4.3 Reservation of Rights

​

All rights not expressly granted to you under these Terms are reserved by Webheadcase LLC. This license does not constitute a sale of the App or any portion thereof.

5. User-Generated Content

​

5.1 Types of User Content

​

The App may allow you to post, upload, submit, or share content including reviews, ratings, check-ins, photographs, comments, and other materials (collectively, "User Content").

​

5.2 Ownership and License

​

You retain ownership of your User Content. However, by submitting User Content to BrewHop, you grant Webheadcase LLC a worldwide, royalty-free, non-exclusive, perpetual, irrevocable license to use, display, reproduce, modify, adapt, publish, translate, and distribute your User Content in connection with operating, promoting, and improving the App and its services. This license continues even if you stop using the App or delete specific content, to the extent that content has already been incorporated into the App's services.

5.3 User Representations and Warranties

​

By submitting User Content, you represent and warrant that:

​

• You own or have the necessary rights, licenses, and permissions to submit the User Content and to grant the license above;

• Your User Content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party;

• Your User Content complies with these Terms and all applicable laws and regulations.

5.4 Prohibited User Content

​

You agree not to post User Content that is:

​

• Defamatory, libelous, or knowingly false or misleading;

• Obscene, pornographic, or sexually explicit;

• Harassing, threatening, abusive, or discriminatory;

• Infringing of any third-party intellectual property, privacy, or publicity rights;

• Promotional of illegal activities or irresponsible alcohol consumption;

• Targeted at or designed to appeal to individuals under the age of 21;

• In violation of any applicable law or regulation.

5.5 Content Removal

Webheadcase LLC reserves the right, but not the obligation, to review, edit, refuse to post, or remove any User Content at any time and for any reason, without prior notice to you. Removal of User Content does not constitute an admission of any wrongdoing by Webheadcase LLC.

​

6. Prohibited Conduct

​

In addition to the restrictions elsewhere in these Terms, you agree that you will not:

​

• Use the App if you are under 21 years of age;

• Impersonate any person, entity, or brand, or misrepresent your affiliation with any person or entity;

• Post false, fabricated, misleading, or fraudulent reviews, ratings, or check-ins;

• Harass, abuse, threaten, intimidate, or harm other users, brewery partners, or Webheadcase LLC personnel;

• Attempt to gain unauthorized access to any part of the App, its servers, databases, or related infrastructure;

• Upload, transmit, or distribute viruses, malware, ransomware, spyware, Trojan horses, or any other harmful or malicious code;

• Use the App to send unsolicited messages, spam, or unauthorized advertising;

• Collect, harvest, or store personal data of other users without their express consent;

• Engage in any activity that disrupts, interferes with, or imposes an unreasonable burden on the App's servers or infrastructure;

• Violate any applicable local, state, national, or international law, regulation, or ordinance in connection with your use of the App;

• Use the App for any purpose other than its intended, personal, non-commercial use as a brewery discovery and planning tool.

Violation of any of the prohibitions in this Section may result in immediate account suspension or termination and may expose you to civil or criminal liability.

7. Brewery Partner Content

​

7.1 Source of Information

​

Brewery menus, tap lists, operating hours, location information, and other brewery-specific details displayed in the App are provided directly by brewery partners, sourced from publicly available data, or obtained from third-party data providers. This information is provided as a convenience to users.

​

7.2 No Accuracy Guarantee

​

Webheadcase LLC does not guarantee the accuracy, completeness, timeliness, or reliability of any brewery information displayed in the App. Brewery details — including hours, tap lists, menus, and availability — are subject to change at any time without notice to Webheadcase LLC or to users.

​

7.3 User Verification Responsibility

​

Before visiting any brewery, users are strongly encouraged to verify current operating hours, menu availability, and any other relevant information directly with the brewery. Webheadcase LLC shall not be responsible for any inconvenience, cost, or harm resulting from inaccurate or outdated brewery information.

​

7.4 Partner Relationships

​

Webheadcase LLC's display of a brewery within the App does not constitute an endorsement, warranty, or recommendation of that brewery or its products or services.

​

8. Location Services

​

8.1 Use of Location Data

​

BrewHop uses your device's location data to provide core features of the App, including nearby brewery discovery, distance calculation, and the Hop Planner itinerary tool. These features may not function properly without access to location data.

​

8.2 Permission and Control

​

Location access is requested through your device's standard operating system permission prompts (iOS or Android). You may grant, deny, or revoke location permission at any time through your device settings. Revoking location permission may limit or disable certain core features of the App. Webheadcase LLC is not responsible for any loss of functionality resulting from your choice to restrict location access.

8.3 Privacy

​

The collection, use, storage, and sharing of your location data are governed by the BrewHop Privacy Policy, which is incorporated into these Terms by reference. By using location features, you consent to the collection and use of location data as described in the Privacy Policy.

​

9. Intellectual Property

​

9.1 Webheadcase LLC Ownership

​

The BrewHop name, logo, application design, user interface, source code, features, functionality, text, graphics, and all other content created by or on behalf of Webheadcase LLC (collectively, the "Webheadcase LLC IP") are the exclusive property of Webheadcase LLC and are protected by applicable copyright, trademark, trade dress, and other intellectual property laws of the United States and international jurisdictions.

9.2 No Unauthorized Use

​

You may not copy, reproduce, republish, upload, post, transmit, distribute, modify, or create derivative works from any Webheadcase LLC IP without prior written consent from Webheadcase LLC. Any unauthorized use of Webheadcase LLC IP is a violation of these Terms and may constitute an infringement of applicable intellectual property laws.

9.3 Feedback

​

If you choose to submit ideas, suggestions, feedback, or other communications to Webheadcase LLC regarding the App or its features ("Feedback"), you agree that such Feedback is non-confidential and that Webheadcase LLC may use, implement, or share such Feedback for any purpose without any obligation, attribution, or compensation to you.

10. Third-Party Services and Links

​

10.1 Integration with Third Parties

​

The App may integrate with or provide links to third-party services, platforms, or applications, including but not limited to mapping services, analytics providers, payment processors, and social sharing platforms (collectively, "Third-Party Services").

​

10.2 No Responsibility for Third Parties

​

Webheadcase LLC is not responsible for the content, accuracy, privacy practices, availability, security, or reliability of any Third-Party Services. The inclusion of a link to or integration with a Third-Party Service does not constitute an endorsement by Webheadcase LLC.

​

10.3 Separate Terms Apply

​

Your use of Third-Party Services is governed by the terms of service and privacy policies of those respective third parties. We encourage you to review those policies carefully before using any Third-Party Services.

​

10.4 User Assumption of Risk

​

You access and use Third-Party Services at your own risk. Webheadcase LLC shall not be liable for any loss or damage of any kind arising from your use of any Third-Party Services.

11. Disclaimers and Limitation of Liability

​

11.1 "As Is" Disclaimer

​

THE BREWHOP APP AND ALL RELATED SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, OR ACCURACY. WEBHEADCASE LLC EXPRESSLY DISCLAIMS ALL SUCH WARRANTIES TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

11.2 No Guarantee of Availability

Webheadcase LLC does not warrant that the App will be available at all times, uninterrupted, error-free, secure, or free from viruses or other harmful components. Webheadcase LLC does not warrant that any defects will be corrected or that the App will meet your specific requirements.

​

11.3 No Liability for User Decisions

​

Webheadcase LLC is not responsible for any decisions you make based on content displayed in the App, including decisions to visit a particular brewery, consume alcohol, or plan activities based on App information. You acknowledge that your use of the App and your choices in connection with alcohol consumption are your own personal responsibility.

​

11.4 Limitation of Liability

​

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WEBHEADCASE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, PARTNERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE APP, EVEN IF WEBHEADCASE LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11.5 Aggregate Liability Cap

​

To the fullest extent permitted by law, Webheadcase LLC's total cumulative liability to you for any and all claims arising out of or relating to these Terms or your use of the App shall not exceed the greater of: (a) the total amount paid by you to Webheadcase LLC in the twelve (12) months immediately preceding the claim; or (b) one hundred U.S. dollars ($100.00), if no payment was made.

11.6 Jurisdictional Variations

​

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability for certain categories of damages. In such jurisdictions, the disclaimers and limitations above shall apply to the maximum extent permitted by applicable law. Nothing in this Section limits liability that cannot be limited or excluded by law.

12. Responsible Alcohol Use

​

12.1 Discovery Tool Only

​

BrewHop is a brewery discovery and itinerary planning tool only. The App does not facilitate, broker, or enable the purchase, sale, or delivery of alcoholic beverages. Webheadcase LLC is not an alcohol retailer, distributor, or licensee.

​

12.2 User Responsibility

​

You are solely responsible for your own alcohol consumption and for complying with all applicable federal, state, and local laws and regulations regarding the purchase, possession, and consumption of alcohol. Webheadcase LLC accepts no responsibility for the consequences of your alcohol-related decisions.

​

12.3 Encourage Responsible Behavior

​

BrewHop and Webheadcase LLC strongly encourage all users to:

​

• Drink responsibly and in moderation;

• Never drive under the influence of alcohol — always designate a sober driver or use a rideshare service;

• Be aware of and respect local laws regarding public alcohol consumption;

• Look out for the well-being of others in your group.

​

12.4 No Use While Driving

​

The App must not be used while operating a motor vehicle. Use of the App while driving is dangerous and may be illegal. Always pull over safely or use a passenger to interact with the App while in a vehicle.

​

13. Indemnification

​

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Webheadcase LLC and its officers, directors, shareholders, employees, contractors, agents, licensors, and successors from and against any and all claims, demands, actions, liabilities, losses, damages, judgments, penalties, fines, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to:

• (a) your access to or use of the App;

• (b) any User Content you submit, post, or transmit through the App;

• (c) your violation of any provision of these Terms;

• (d) your violation of any applicable law, regulation, or ordinance; or

• (e) your violation of the rights of any third party, including without limitation any intellectual property, privacy, or publicity rights.

Webheadcase LLC reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you agree to cooperate with Webheadcase LLC in asserting any available defenses.

14. Termination

​

14.1 Termination by Webheadcase LLC

​

Webheadcase LLC may suspend, disable, or permanently terminate your account and your access to the App at any time, with or without cause and with or without notice, at its sole discretion. Non-exhaustive grounds for termination include:

​

• Violation of any provision of these Terms;

• Conduct that is harmful, abusive, or offensive to other users, brewery partners, or Webheadcase LLC;

• Discovery or reasonable suspicion that the user is under 21 years of age;

• Extended account inactivity; or

• Any request from law enforcement or regulatory authorities.

• ​

14.2 Termination by User

​

You may terminate your account at any time by:

• Navigating to Settings → Account → Delete Account within the App; or

• Sending a written termination request to webheadcase@webheadcase.com from the email address associated with your account.

• ​

14.3 Effect of Termination

​

Upon termination of your account for any reason:

​

(a) the license granted to you under Section 4 is immediately and automatically revoked;

(b) you must cease all use of the App and delete it from your device(s); and

(c) Webheadcase LLC may delete or retain your account data in accordance with the Privacy Policy and applicable law.

14.4 Survival

​

The following Sections shall survive any termination or expiration of these Terms and shall remain in full force and effect: Section 5.2 (Content License), Section 9 (Intellectual Property), Section 11 (Disclaimers and Limitation of Liability), Section 13 (Indemnification), Section 15 (Governing Law and Dispute Resolution), and any other provisions that by their nature should survive termination.

15. Governing Law and Dispute Resolution

​

15.1 Governing Law

​

These Terms and any dispute arising out of or relating to these Terms or your use of the App shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions or principles.

​

15.2 Informal Resolution

​

Before initiating any formal dispute proceeding, you agree to first attempt to resolve any dispute informally by contacting Webheadcase LLC at webheadcase@webheadcase.com with a written description of the dispute, the relief sought, and your contact information. Webheadcase LLC will attempt to respond within a reasonable time. If the dispute is not resolved within 30 days of submission, either party may proceed to binding arbitration as described below.

15.3 Binding Arbitration

​

If informal resolution is unsuccessful, any and all disputes, claims, or controversies arising out of or relating to these Terms or the App shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules then in effect. The arbitration shall be conducted in [City, State], unless the parties mutually agree otherwise. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

15.4 Class Action Waiver

​

BY AGREEING TO THESE TERMS, YOU EXPRESSLY WAIVE YOUR RIGHT TO PARTICIPATE IN ANY CLASS ACTION LAWSUIT, CLASS-WIDE ARBITRATION, OR ANY OTHER REPRESENTATIVE PROCEEDING AGAINST WEBHEADCASE LLC. ALL DISPUTES MUST BE BROUGHT SOLELY ON AN INDIVIDUAL BASIS.

15.5 Equitable Relief

​

Notwithstanding the arbitration agreement above, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction where necessary to prevent irreparable harm, pending the outcome of arbitration.

​

16. Changes to the App

​

16.1 Modifications and Discontinuation

​

Webheadcase LLC reserves the right to modify, update, suspend, or permanently discontinue the App — or any feature, functionality, or content within the App — at any time, for any reason, with or without notice to you.

​

16.2 No Liability for Changes

​

Webheadcase LLC shall not be liable to you or any third party for any modification, price change, suspension, or discontinuation of the App or any of its features. Your continued use of the App following any modification constitutes your acceptance of those changes.

Miscellaneous Provisions

​

Entire Agreement

​

These Terms, together with the BrewHop Privacy Policy and any additional terms applicable to specific features of the App, constitute the entire agreement between you and Webheadcase LLC with respect to the subject matter herein, and supersede all prior or contemporaneous understandings, agreements, representations, and warranties.

​

Severability

​

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

​

Waiver

​

No failure or delay by Webheadcase LLC in exercising any right or remedy under these Terms shall constitute a waiver of that right or remedy. A waiver of any right in one instance does not constitute a waiver of that right in any future instance.

​

Assignment

​

You may not assign or transfer these Terms or any of your rights or obligations hereunder without the prior written consent of Webheadcase LLC. Webheadcase LLC may freely assign these Terms, including in connection with a merger, acquisition, or sale of all or substantially all of its assets, without your consent.

​

Force Majeure

​

Webheadcase LLC shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, labor disputes, power failures, or governmental actions.

​

Headings

​

Section headings in these Terms are for convenience and reference only and shall not affect the interpretation or construction of these Terms.
